Only one partner needs to actually file for the divorce; his or her first step is to download a package of forms from the state. There is the Acknowledgement of Service form for spouses who both live in the same county, and the Acknowledgement of Service and Waiver of Jurisdiction for spouses resident in different counties. After the correct forms are completed, the partner doing the filing must make four copies of each file them with his or her County Court Clerk’s Office. The fee varies by county from $200 to $220.

If the marriage has produced children, you and your spouse are both required to attend Parental Guidance Classes. The Divorce cannot be completed until this requirement has been satisfied. The Court Clerk will guide you as to as to the availability and location of acceptable classes. When you successfully complete the course, you will be issued a certificate, which you will need to keep, as you will need it later.

As soon as 30 days have passed since the filing of the papers and the payment of the fee, you are entitled to ask The Court to schedule a hearing date. It is now that you must fill out one of the final forms required to affect a divorce, and that is the Georgia Final Judgment and Decree. You must take this completed document with you to the Hearing. If everything has been accomplished to the Judge’s satisfaction, he or she will issue a Final Judgment. The very last step is for you to file the Domestic Relations Case Final Disposition Info Form with the County Clerk’s Office. With that task accomplished, you officially divorced in Georgia.
