The Nebraska divorce forms must be filed in the Clerk of the District Court as long as the petitioner meets the following requirements such as; must be a resident for at least twelve (12) months and grounds for a no-fault divorce must be “Irretrievable breakdown of the marriage”.

How to File For Divorce in Nebraska
Step 1 – Gather the following forms and fill them out as best to your ability;
File the forms with the Circuit Court Clerk’s Office and pay the filing fee of $157 which includes the Civil Docket Fee. If you cannot pay, you may apply to waive the fees by filing the following forms and following the instructions;
Step 2 – You have two options in this step. Have the County Sheriff serve your spouse the forms including the Praecipe of Summons or to have the spouse fill out a Voluntary Appearance Form. If either option is not available the petitioner will have to make a service by publication.
- If there are minor children of the marriage, the spouses are required to attend parental training classes and receive a Certificate at the end to file with the clerk’s office.
After either serving the spouse or having them fill out the Voluntary Appearance Form, it must be returned to the clerk’s office along with the Parental Education Classes Certificate (if applicable)
If the spouse decides to file an Answer to dispute the facts of the petitioner, one of the following documents must be filed;
Step 3 – The petitioner can request a hearing sixty (60) days after the date the Defendant was served. Upon receiving the date, the Petitioner must send to the Defendant the Notice of Hearing.
Step 4 – Bring the following forms to the court hearing;
Step 5 – Attend the hearing. As long as both spouses remain in agreement the Judge will authorize the Decree and the divorce will be filed and finalized after thirty (30) days.
