The New York divorce papers allow for a spouse to file for a no-fault divorce under the grounds of “irretrievable breakdown” (Statute 10-170) of at least six (6) months. One of the spouses must be a resident of the State for at least two (2) years.

How to File For Divorce in New York (No-Fault)

Step 1 – The spouse that has decided to file must complete one of the following forms;

Step 2 – File the selected form with the County Court Clerk’s Office and pay the $210 fee for obtaining an index number. The date of filing and the index number must be placed on the forms filed.

Step 3 – As long as the non-filing spouse is in agreement with the divorce, the following forms must be sent in addition to the filed forms;

The Affidavit of Defendant must be completed and given back to the filing spouse for filing with the clerk’s office.

The forms must be filed back with the clerk’s office within one hundred and twenty (120) days

Step 4 – The filing spouse may now place a date on the court’s calendar by filing the following forms. There is a forty (40) day waiting period unless the Defendant signs the Affidavit of Defendant.

File all applicable documents with the Clerk’s office. There will be another filing fee which can be found on Page 5 of the Request for Judicial Intervention (UD-13). If the papers are found to be completed to the god standing of the Judge, the Judgment of Divorce will be authorized and the process will be complete.
