Pennsylvania eviction notice forms under law allows a landlord to a evict tenant for failure to pay rent, violating the lease, or when the lease expires.

1. Notice

Landlords must give tenants notice before filing an eviction, unless the lease says that this is unnecessary. The length of notice depends on the reason for the eviction. The notice for failure to pay rent  must be given at least 10 days before the landlord can file the eviction. For any other reason, the property owner must give 15 days’ notice for leases that are one year or less, and 30 days’ notice for leases that are for longer than one year.

Notice must be personally delivered to the tenant or posted on the door.

2. Summons and Complaint

If the tenant does not move, the landlord should file an eviction complaint with the local court. Then the landlord must serve the tenant. A hearing will be scheduled within two weeks.

3. Hearing

The eviction hearing typically will occur before a Magisterial District Judge. Each party should obtain legal advice before the hearing. To evict the tenant, the landlord must prove the tenant failed to pay rent or violated the lease. The tenant may also present a defense. For example, the tenant could try to show that he did not violate the lease.

If the property owner wins, the court will issue an order requiring the tenant to move out within 10 days. During that time, the tenant may file an appeal. If the tenant does not appeal and remains on the property, the landlord can obtain an order to authorize the sheriff to physically remove the tenant after another 11 days have passed.
