The Texas purchase and sale agreements can be used for a potential buyer to create a legal contract for a residential (improved or unimproved), condominium, or commercial property. The agreements are to be used after verbal negations have taken place or if the buyer is looking to place a formal offer.

The contract needs to be signed in order to be considered legal but it is recommended that a witness or notary public is able to view the signatures. Depending on the situation, there may be disclosures needed to be attached in addition to the following;

• Property Disclosure Statement – For the seller to identify any problems that they have knowledge.
• Lead Based Paint – If the structure on the property was built prior to 1978 it is required that this form be attached to the contract to let the buyer know of the toxic hazard.
