Disclosures (Residential Only)

  • Flooding – For areas that have been flooded in the last five (5) years.

Complete the Oklahoma commercial and residential lease agreements to bind a landlord and tenant into a real estate contract where a lessee will make monthly payments to lessor, usually on the first (1st) day, to occupy property. It is recommended that the landlord perform a lookup of the tenant’s credit and previous rental history before authorizing an agreement. If either party has any disagreement(s) or has questions about their rights they should review the Landlord and Tenant Residential Act (Title 41).

  • Rental Application – Advised by all landlords, managers, and agents to properly screen an applicant’s credit, background, rental history, employment (including income), and any references provided. The information will provide the landlord with sufficient details about the potential tenant and be a guide to whether the person is credible or not for a fixed term lease agreement.
  • Residential Lease Agreement – Provided by the Oklahoma Real Estate Commission (OKREC), the contract binds both landlord and tenant into a rental arrangement for typically a one (1) year term. The tenant is obligated to pay a fixed monthly amount on a date specified in the agreement and if not paid the landlord may charge a fee. Both parties must adhere to the terms and conditions and any violation may result in a possible eviction or breaking of the lease.
  • SubLease – When a tenant decides to rent the same space they are renting to someone else, otherwise known as the sublessee. The individual renting the space, sublessor, should make sure it is an allowable use in their original lease and be aware that they will be fully responsible for any acts made on behalf of the sublessee on the property.
  • Month to Month (Tenancy at Will) – Type of contract that has no end date but allows either the landlord or tenant to cancel the arrangement with at least thirty (30) days’ written notice to either party (According to 41-111).
  • Commercial – For the exclusive use of retail, office, and industrial space. A business tenant may use this document to create a legally binding arrangement with a landlord to occupy space for a stated period of time. A landlord should always verify with the Oklahoma Secretary of State to ensure that the entity is in “Good Standing” and is up to date with all it’s filings.
