The Washington (State) rental agreements allows an owner of property to legally rent to a prospective tenant for payment. The landlord may ask for an application (a fee may be included) in order to run a credit check of the tenant. If approved he or she will be required to put up a security deposit along with the first month’s rent. When these items are received along with the signed lease, access of the premises shall be granted. If landlord or tenant has questions about their rights they should refer to the Landlord/Tenant’s Handbook.

Disclosures

Security Deposit – If the landlord requests a deposit from the tenant they will have to do the following;

  • Provide a Move-in Checklist and it must be completed prior to occupancy;
  • Provide the bank name, street address, and account of where the funds are being held.

Safety – The landlord must provide information regarding the smoke and gas alarms on the premises and any emergency exit routes.

Form Descriptions

  • Rental Application – Permits a property owner or manager to review a potential tenant’s credit, job, and rental history by retrieving a credit report and verifying references. Most applications are just run through a simple credit report but some landlords who are more cautious of who exactly they want in their property may complete a more thorough search. The processing time can be anywhere from instant to three (3) days and upon approval the tenant will know what the deposits required will be and the rental amount (unless previously agreed upon).
  • Residential Lease – Ten (10) pages long and is editable in Microsoft Word (.doc) or fillable in PDF format. The legal form allows a landlord to sign a tenant for a length of time (usually 1 year) to occupy and make payments on a residential property. An application may be required by the landlord or management company which should take 2 to 3 days to process. There may be a fee assessed for accepting the application but after approval a certified lease will be sent for authorization. Once the agreement has been signed by both landlord and tenant it becomes a legally binding document.
  • Tenancy at Will (Month-to-Month) – Type of arrangement as described in 59.18.200 which permits a tenant and landlord to authorize a rental document with no stated end date but either party may terminate within twenty (20) days.
  • Sublease – The act of a tenant renting space to someone else, ‘sublessee’, in return for monthly rent. The sublessor may rent a portion or the entire space to the sublessee at their option. The sublessor must always ensure that it is legal to sublet the property either through permission in their original rental contract or by written permission from the property owner/manager.

Landlord-Tenant Laws

  • Security Deposits
    • Limit – None. Landlord may require as much as desired.
    • Returning – Landlord must send the tenant’s deposit within fourteen (14) days of move-out.
  • Access to Property – Landlord must give at least forty-eight (48) hours for any scheduled maintenance or repair. Only twenty-four (24) may be given if showing the premises to a new tenant.
  • When is Rent Due – Rent is due on the date specified in the signed contract.
