How to File
Step 1 – Select Type – Choose the type of corporation you will be forming in Delaware from the following options;
Step 2 – Pay Fee – All new filings have an $89 filing fee required (*$249 for foreign, or ‘out of state’). Make all payments to the Delaware Secretary of State’s office.

- Apply for EIN – Otherwise known as a Employer Identification Number, is obtained from the IRS either in paper form or online. This number acts like a Social Security number to an individual whereas an entity will need this to open a bank account or establish a credit line.
- Corporate Bylaw – It is recommended that every corporation create a corporate bylaw to outline and establish the roles and day to day functions of the business. It is not filed with the Secretary of State but may be asked to be viewed by outside parties.
