If you have been granted a federal extension by filing Form 4868, you are automatically extended the same amount of time to file with the state of New Mexico through October 15th. It will not be necessary to file Form RPD-41096 if you have been granted an extension through the IRS. If you expect to file your federal return by the original due date or by October 15th yet you need additional time to file your New Mexico return, you will need to submit Form RPD-41096, on or before the due date of the return or the extended due date of the return.
