Utah Rental Lease Agreement Forms and Templates
A Utah rental agreement legally permits a person to occupy property while pay monthly rent. Download and complete with a tenant and upon both parties signature it becomes a legal document. A tenant will usually be issued access to the premises immediately once all deposits and first months’ rent has been paid. - Rental Application – A tenant will use this form to show a landlord his or her financial credentials including employment references and prior rental history. There may be a fee applied by the landlord and is usually processed within 2 to 3 business days and can be instant if a credit report is the only thing required. If approved, the manager will usually print a new lease ready for the tenant to sign.
- Residential Lease (BAR Version) – This form has been provided by the Utah State BAR for a landlord to legally protect themselves and rent property to a tenant. The most negotiated items in any contract is the monthly payment amount. A landlord may request to view the potential tenant’s credit report and references with an application. Once the parties have signed the agreement it becomes legally binding and both parties should keep copies of originals for their records.
- Month to Month Lease – Also known as a tenancy at will, this document allows for a contract to be made between a landlord and tenant for the use of property without an end date. According to statute 78B-6-802 either party may cancel the agreement with at least fifteen (15) days written notice (Use the Termination Form).
- Sublease Agreement – Allows a renter (“sublessor”) to look for another person (“sublessee”) to lease a portion or the entire property that is currently under a rental agreement. If subletting is not allowed in the original contract the sublessor will have to seek written permission from the landlord. The sublessee will be the sole responsibility of the sublessor including the collection of rent and if any evictions need to be done. A sublease may not go further than the original lease agreement date and once signed by both parties the document becomes legal.
Common Landlord-Tenant Laws
- Security Deposit
- Limits – No statutory limit, landlord may collect as much as desired
- Returning – Within thirty (30) days the landlord must send the deposit back to the tenant
- Access – Twenty-Four (24) hours notice must be granted before landlord may enter the premises
- When is Rent Late – Any time after the due date in the lease. There is no State grace period.
