Disclosures

  • Radon Disclosure – If radon gas exists at an unusually high level in the State of Maine, the landlord must disclose this information to the tenant(s).
  • Energy Efficiency Disclosure – Must be attached to the lease to provide information about the rental units effectiveness of retaining heat in the premises.
  • Lead Based Paint – If the structure was built before 1978 this disclosure is required to be signed and attached to the lease agreement

The Maine rental agreements allow a contract between a person that controls property and someone else seeking to occupy in exchange for payment. The standard lease is 1 year but can be any term as agreed upon by the parties. Landlord and tenant should view the Maine Statutes on Rental Property (Title 14 Chapter 710) if there are any questions or disagreements.

  • Rental Application – Use this form in order for a tenant to apply for lease to a residential unit. The party that receives this form will have the full right to look-up credit, employment, rental history, and any references that were provided.
  • Sublease – A tenant may use this legal form to rent their space to another potential lessee, “SubTenant”, to collect rent in return for the use of the space. In most lease agreements, it the right of subleasing is strictly prohibited, therefore it is required to obtain written permission from the landlord or property manager.
  • Month to Month – Also known as “tenancy at will”, is mainly for short term tenants or for use after a one (1) year agreement where the lease extends every month as long as rent is paid. Either party at anytime can cancel or change the agreement with written notice to one another.
  • Standard one (1) Year – Provided by the Attorney General and allows a landlord to rent property to another individual in return for monthly payments. The most common length is a twelve (12) months but may be any time as determined by the parties. It is highly recommended that the landlord or it’s agent have the tenant complete a rental application to ensure that he or she is able to afford the payments.

  • Access – Must give twenty-four (24) hours before entering for non-emergency use
  • When is Rent Due – There is a fifteen (15) day grace period before rent is considered late
