Idaho Rental Lease Agreement Forms and Templates


Idaho lease agreements allow for a person to rent property (residential or commercial) from someone else in exchange for monthly payment. A potential lessee may rent on a 12 month, month to month (where the terms may be able to change at anytime with at least 30 days notice), or Sublease (renting from a tenant that has lease with the Landlord). In order to be legal the document must be signed by both landlord/management company and the tenant. Always refer to the Idaho landlord tenant handbook if there are any disputes or questions about statutory real estate rules.

  • Rental Application – A landlord or manager of property should use this to screen and verify that a potential tenant can or will pay monthly rent. Whomever authorized this form grants their consent for the other party to be able to view their credit rating as well as verify employment status.
  • Standard 12 Month – Legally lets a person (tenant) to rent property from someone else (landlord). Each party must adhere to the terms and conditions of the contract which is mostly the tenant must pay the rent on time every month and the landlord must keep up to date with the utilities.
  • Month to Month – A month to month lease agreement in Idaho lets a landlord and tenant have an agreement where one person may be able to rent space from the other in return for recurring monthly payments. There is technically no end to this type of arrangement and the only way for a change or termination of the contract is if one party notifies the other with written notice. The landlord or tenant by law only has to give the other party fifteen (15) day notice of any change except for termination, which must be at least thirty (30) days notice.
  • Sublease – Allows a tenant to be able to divide or rent the entire space being occupied to another person known as the “sublessee”. The tenant is fully responsible for the sublessee for property damage and vacating the premises as well as if payment is not made the landlord must still be paid in full.

Common Landlord-Tenant Laws

  • Security Deposit
    • Statutory Limit – None. The landlord may collect as much as he or she desires for the rental unit
    • Return – The deposit must be returned to the tenant minus any deductions due to property damage within twenty one (21) days
  • Entry – The landlord does not have to give notice to the tenant prior to entering for any repair or non-emergency access. Although it is recommended that the manager or owner provide some sort of notification before entering.
