New Mexico power of attorney allows the representation of another person for monetary, health care, state tax filing, Motor Vehicle Division, or guardianship based decisions. When filling in it is best to have your representative present (known as the “Agent” or “Attorney-in-Fact”). The document must then be signed in front of a notary which can be found at every branch bank (recommended) or two witnesses.

Durable Financial – Allows a representative to step in and act for you in any type of monetary decision within New Mexico. The powers are unlimited and remain valid even if the principal should not be able to think for themselves due to a mental condition (Example; Dementia, Alzheimer’s, Coma, etc.).
Health Care – Select an agent to make health care decisions to your benefit if you are being hospitalized or cannot make the decisions for yourself. The form only goes into effect upon incapacitation and the person chosen must follow your guidance as written on the form.
State Tax – Use the following document to choose a professional to handle your tax filing with the department of revenue.
Motor Vehicle Division – A limited power of attorney document that allows a person to handle a sale, title, or registration of a vehicle located within the State. The form must be witnessed by a notary public in order for it to be considered valid.
POA For Minor Child – Allows a family member to receive guardianship rights over a minor for a period up to six months. If the arrangement is to continue the parent and agent must authorize a new document. Must be signed in the presence of a notary public.
