Hawaii Rental Lease Agreement Forms and Templates


Hawaii rental agreements create a legal document that allows a tenant to occupy property from someone else. There are three main types; Standard (12-month), month to month, and sublease agreements. Typically a potential tenant will need to apply for a lease through an application where his or her credit and validation of employment will be checked. All tenants and landlords should refer to the landlord-tenant handbook to view applicable laws and rules under the State of Hawaii.

  • Rental Application – Allows a person to apply for a residential dwelling in the State of Hawaii. The manager or landlord of the property may use the information to verify the financial capabilities by looking up his or her credit rating and check with employers.
  • Standard 1 Year – Is a legal contract that binds both the lessee and landlord into an agreement for the occupation of property in return for monthly payments. Both parties must adhere to the terms and conditions as set forth in the written document and any violation by either party can result in the breaking of the lease.
  • Month to Month – Is popular among winter rentals because it allows the tenant to stay as long as he or she pays rent every month. There is no end date to this type of arrangement and any details of the contract may be changed or voided with written notice to the other party of at least thirty (30) days unless;
    • Termination by the landlord must be at least forty five (45) days
    • Termination by the tenant must be at least twenty eight (28) days
  • Sublease – Allows a person (“sublessor”) that is under a master lease with a landlord to be able to rent a portion or the entire property to a sublessee. The length of the sublease cannot go further than the master agreement and the sublessor has the full responsibility of the sublessee including but not limited to; payment, damage to the premises, vacating, etc.

Common Landlord-Tenant Laws

  • Security Deposit
    • Maximum – Landlord may not legally require more than one (1) month’s rent
    • Returning – The deposit must be given back to the tenant within fourteen (14) days of the lease end date
  • Access – Landlord must provide at least two (2) day’s notice before entering the property for use other than emergency related
